from www.ctv.ca – A trial is underway for a Quebec high school phys-ed teacher accused of having an “intense” sexual relationship with one of her students between 2002 and 2004.
Tania Pontbriand, now 41, was 32 and the student was 15 when the relationship allegedly began at Rosemere High School in a suburb of Montreal. The student is now in his 20s.
CTV Montreal’s Stephane Giroux, reporting from the St. Jerome courthouse, said prosecutors are alleging the pair had sex more than 300 times, in locations that included the back seat of her car, the school, and on camping trips.
“The accused, her defence will be that it never happened, that the affair is a figment of the boy’s imagination,” Giroux said.
However, he noted that police claim to have DNA evidence from a sleeping bag they say was used by the pair on camping trips.
Giroux reported Tuesday evening that the prosecution did not get a chance to open its case because the defence made several attempts to have the charges dismissed.
The defence argued that Pontbriand’s right to a speedy trial has been violated since the alleged crimes occurred so long ago.
The boy went to police in 2007, several years after he claims the relationship ended. The teacher was charged in 2008 and it has taken until now for the case to go to court.
The judge allowed the proceedings to continue, and Pontbriand may take the stand on Wednesday.
Pontbriand has been charged with one count of sexual assault and two counts of sexual exploitation of a minor.
