Nevada County Supervisors to discuss smut moratorium

from www.theunion.com – Nevada County’s moratorium against strip clubs, adult bookstores and other salacious businesses could continue another year.

On Tuesday, Supervisors are being asked by staff to extend a moratorium against adult businesses until September 2012, while county planners work on a draft to regulate the currently non-existent adult industry in Nevada County.

Since such businesses are protected by the First Amendment, county officials cannot ban them outright, and planners “anticipate presenting a draft ordinance to the Planning Commission in the fall of 2011,” according to a staff report.

Planning Commissioners would then debate the ordinance and make a recommendation to supervisors to accept it or not.

Other adult business ordinances, such as those in Placer County and Truckee, regulate adult businesses by keeping them up to 1,000 feet away from schools, churches, homes and places frequented by minors, and set regulations mandating security at strip clubs.
