Proprietor, adult store indicted

Kansas- A monthlong grand jury investigation into seven adult shops in Wichita now centers on one movie, one store and one man.

Sedgwick County District Attorney Nola Foulston announced Tuesday that a grand jury had indicted Priscilla’s owner Bob Floyd of Oklahoma City and one of his two Wichita stores on one count of promoting obscenity, a class A misdemeanor. It is punishable by up to a year in jail and a maximum $2,500 fine.

Priscilla’s stores — known for their jaunty theme song, “Where fun and fantasy meet,” –are popular places to buy gifts for bachelorette and bachelor parties.

The indictment is against the Priscilla’s store on West Kellogg and centers on a DVD about oral sex, judging from the movie’s title. The 120-minute movie from studio Extreme 2.0 is available on the Internet, but a spot check Tuesday afternoon didn’t find other stores that carry it locally.

The grand jury began meeting Sept. 19 after a group called Operation SouthWind gathered enough petitions to press for an investigation into whether seven of Wichita’s 15 adult stores violated community standards of obscenity.

Steve Joseph, Floyd’s lawyer, said his client is not guilty of promoting obscenity.

“It’s real simple,” Joseph said. “The fundamental question in all of these cases where someone elects to proceed in the criminal courts has to do basically with the community standards. What are the community standards of Wichita, Kansas, with regard to the sale or rental of sexually explicit movies to consenting adults for non-public viewing?”

Past cases, including some he prosecuted, Joseph said, have shown that “Wichita, Kansas, like most other places, says it’s OK.”

Floyd declined to comment Tuesday. He was the only adult-store owner who spoke to The Eagle for an article published in October. Floyd — who owns 13 Priscilla’s stores in four states — said then that his stores help adults who want to enjoy a healthy sex life.

His stores sell sex toys such as vibrators, sex-themed games and lingerie.

Operation SouthWind’s president, Jan Beemer, said in a previous interview that graphic movies were a concern at most stores targeted in the grand jury investigation. She was unavailable for comment Tuesday.

The Rev. Pete Dominguez, vice president of Operation SouthWind and a pastor at the South City Southern Baptist Church, said he was disappointed by the outcome of the investigation.

“I’m saddened that they only came back with one indictment, but I have no idea of what kind of evidence they looked at and no idea what they determined their decision on,” he said.

The investigation focused on seven stores: Priscilla’s at 6143 W. Kellogg; the Adult Super Store at 5858 S. Broadway; After Dark Video at 7805 W. Kellogg; Camelot Cinema at 1515 S. Oliver; X-Citement Video at 1306 E. Harry; X-Citement Video at 220 E. 21st St.; and Zigefield’s at 4200 W. Kellogg.

Georgia Cole, a spokeswoman for the district attorney’s office, said she could not give out details about the grand jury’s investigation except to announce the charge and that a trial is scheduled for Dec. 13.

Joseph said he planned to file a request to move the trial from a bench case to a jury trial. He expects the case to go to trial in early spring.
